A former delivery rider of Lalamove Philippines has filed a complaint before the National Labor Relations Commission (NLRC) for alleged illegal dismissal. Accompanied by his lawyer, Exequiel Busa, Jr. personally went to the NLRC this morning to bring charges against the logistics company.
The arbitrary dismissal complaint stemmed from a protest rally that was staged by a group of Lalamove riders, including Busa, seven months ago in front of the company’s main office in Quezon City. This is in connection with the alleged implementation of a low-base promo, exorbitant 20% commission rate, and P200 rental fee for delivery bags.
Members of the Kapatiran sa Dalawang Gulong (Kagulong), an organization that pushes for the rights of delivery riders, were present during the filing of the complaint as an expression of support.
“Hindi naman kami mga robot na pinipindot lang para utusan. Manggagawa kami na may pakiramdam bilang tao at may karapatang magreklamo kapag naaapakan,” Busa was quoted in a statement released by Kagulong.
“Nagtatrabaho kami madalas ay lagpas sa walong oras para kumita pero sa mas malaking kapakinabangan ng kompanya. Pero ang tanggalin kami ng walang due process dahil lamang sa pagpapahayag ng aming mga hinaing ay labis pa sa batas militar,” he added.
Kagulong secretary general Don Pangan urged the Department of Labor and Employment (DOLE) to resolve, once and for all, the fundamental issue on whether gig delivery riders are hired as regular employees or contractual workers to be assured of the security of tenure.
“Na-resolve na ang isyung ito, na ang gig workers are employees, sa ilang bansa tulad ng UK, Spain, at nitong huli ay sa (The) Netherlands. Pero dito sa Pilipinas mahinang uri ng advisory pa lamang ng DOLE ang nagagawa,” Pangan explained.
He also lamented DOLE’s alleged failure to convene a technical working group, which will coordinate with stakeholders and even delivery riders in drafting a department order defining the status of motorcyclists under logistics companies.
